The complaint, filed on 11 February in the US District Court for the Southern District of New York, names TJX Companies, the parent company of TJ Maxx and Marshalls, and addresses the sale of alleged imitation products. TJ Maxx is an American discount department store chain.
A company spokesperson stated that, like many successful brands, David Yurman has faced an increase in imitation products.
“David Yurman has had to confront the proliferation of dupes – copies of brand-name goods that are meant to look just like the authentic designer version but without the designer price tag,” he said.
“The growing trend of dupes – where an artist’s hard work is slavishly copied by unscrupulous third parties – undermines the entire nature of creative design and expression.”
The company alleges that the imitations closely resemble its products, use inferior materials, and have led some social media users to believe the retailer sells authentic items. TJ Maxx has not responded to requests from the media for comment.
The Fashion Law, which first reported the lawsuit, described the case as a potential test of the 'dupe' economy, a trend some brands view as a commercial threat.
In recent years, New York-based jewellery designer David Yurman pursued legal action against venture capital-backed rival Mejuri for allegedly copying several distinctive jewellery designs.
